El Copyright y la Ley del uso legítimo

Sobre el uso razonable o legítimo del copyright, de la sentencia de la Corte (Norteamericana) de Apelaciones del Segundo Circuito en el caso Authors Guild vs Google Books:

La finalidad última del copyright es expandir el conocimiento y entendimiento público, cosa que el copyright intenta otorgando a autores potenciales control exclusivo sobre la reproducción de sus trabajos, dándoles así un incentivo financiero para crear obras informativas e intelectualmente enriquecedoras para el consumo del público. Este objetivo está claramente reflejado en las facultades que la Constitución da al Congreso de “promover el Progreso de la Ciencia… asegurando a los autores, por un tiempo limitado, el derecho exclusivo a sus escritos”. Es decir, si bien los autores se ven beneficiados de un modo importante por el copyright, la intención primera del copyright es beneficiar al público, cuyo acceso al conocimiento se quiere mejorar proporcionando esas recompensas a los autores1.

This objective is clearly reflected in the Constitution’s empowerment of Congress “To promote the Progress of Science… by securing for limited Times to Authors… the exclusive Right to their respective Writings.” Thus, while authors are undoubtedly important intended beneficiaries of copyright, the ultimate, primary intended beneficiary is the public, whose access to knowledge copyright seeks to advance by providing rewards for authorship.” ↩
